Terms of Use

Welcome to Fash. These Terms of Use ("Terms") govern your access to and use of the Fash mobile applications, websites and related services (together, the "Platform"), operated in the United Republic of Tanzania. By creating an account, browsing as a guest, or placing an order through the Platform, you agree to be bound by these Terms.

1. Who We Are

Fash connects customers with independent service providers and professionals across laundry & garment care, beauty & wellness, custom tailoring, fashion rental, and shopping categories. Some services are fulfilled directly by Fash-affiliated stores; others are fulfilled by independent providers and professionals who use the Platform to reach customers. Fash acts as the marketplace and technology layer connecting the two.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and enter into a binding order. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You may browse and, in some categories, place limited orders as a guest; a full account unlocks order history, saved addresses, and faster checkout.

3. Orders, Bookings and Payments

When you place an order or booking, you are making an offer to purchase goods or services at the displayed price, which the assigned provider or professional then accepts. Prices are shown in Tanzanian Shillings (TZS) unless otherwise stated and may include applicable fees (service fees, delivery fees, or short-notice/late fees) disclosed before checkout. Payment is processed through the mobile money and payment channels made available in the app at the time of checkout, in line with the requirements of Tanzania's Electronic Transactions Act, 2015 for electronic contracting and payment confirmation.

4. Cancellations, Rescheduling and Refunds

Cancellation and rescheduling windows vary by service type and are shown at checkout and on the relevant service's policy page. Fees may apply for late cancellations, no-shows, or rescheduling outside the free window, consistent with the cancellation/rescheduling terms disclosed at the time of booking. Refunds, where applicable, are issued to the original payment method within a reasonable time after approval.

5. Conduct

You agree not to misuse the Platform -- including submitting false information, attempting to circumvent Fash to transact directly with a provider outside the Platform for a service first discovered here, or engaging in abusive, discriminatory, or unlawful conduct toward any provider, professional, or Fash team member.

6. Intellectual Property

The Fash name, logo, app design, and underlying software are the property of Fash and its licensors. Nothing in these Terms grants you any right to use Fash's branding except as necessary to use the Platform as intended.

7. Liability

Fash facilitates connections between customers and independent providers/professionals and, to the extent permitted by the Law of Contract Act (Cap. 345) and other applicable Tanzanian law, is not liable for the acts or omissions of independent providers beyond its role in facilitating the transaction and operating the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded.

8. Consumer Rights

Nothing in these Terms limits your rights under the Fair Competition Act, 2003 (administered by the Fair Competition Commission) or the Sale of Goods Act (Cap. 214) with respect to goods purchased through the Platform.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. Continued use of the Platform after an update constitutes acceptance of the revised Terms.
